An NHAI NOC is mandatory before constructing any vehicular entrance/exit connecting private land to a National Highway, or laying any utility cable/pipe within the Right of Way (ROW). Unauthorized access points are subject to demolition and legal penalties under the Control of National Highways (Land and Traffic) Act, 2002.

Guidelines mandate strict minimum distance separations from intersections (rural vs. urban stretches), minimum plot frontage along the highway, buffer strip widths, and mandatory deceleration/acceleration lanes to ensure safe vehicular merges.

A Provisional NOC provides in-principle permission to build the access layout within 1 year as per approved CADD plans. Following joint site inspection and compliance verification, the formal License Deed is executed between the applicant and the highway authority.

Applicants can apply for an Extension of Time (EOT). Under established MoRTH administrative procedures, extensions are typically permissible for 1 additional year at a time, supported by genuine site justifications.
